End User License Agreement (EULA)

1. License Grant

Subject to your compliance with the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on devices you own or control
• Use the App for personal, non-commercial purposes only

2. License Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright or other proprietary notices in the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its related systems

3. Intellectual Property

The App and all its content, features, and design are our property and are protected by copyright, trademark, and other intellectual property laws. This Agreement does not grant you any rights to our trademarks, logos, or branding.

4. User Content

You retain ownership of the data you enter in the App (such as baby information and vaccination records). You grant us a license to use this data to provide and improve our services.

5. Subscriptions and Payments

Some features require a paid subscription. Subscriptions are processed through Apple App Store or Google Play Store:

• Subscription Options: Monthly, Yearly, or Lifetime plans are available
• Auto-Renewal: Monthly and Yearly subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period
• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
• Renewal: Your account will be charged for renewal within 24 hours prior to the end of the current period
• Management: You can manage and cancel subscriptions in your device's account settings (iOS: Settings > Apple ID > Subscriptions; Android: Play Store > Subscriptions)
• Refunds: Refund requests must be processed through Apple App Store or Google Play Store directly

6. Disclaimer of Warranties

The App is provided "as is" without any express or implied warranties, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, punitive, or consequential damages
• Loss of profits, data loss, or business interruption
• Any damages arising from the use or inability to use the App

8. Termination

We may terminate your license immediately if you violate any terms of this Agreement. Upon termination, you must stop using the App and delete all copies.

9. Agreement Changes

We reserve the right to modify this Agreement at any time. Significant changes will be communicated through in-app notifications or email. Continued use of the App indicates your acceptance of the modified Agreement.

10. Governing Law

This Agreement shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For users in the European Union, local consumer protection laws may apply.

11. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following terms apply:

• This Agreement is between you and BabyVax only, not with Apple Inc.
• Apple has no obligation to furnish any maintenance or support services for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims relating to the App or your possession/use of the App
• Apple is a third-party beneficiary of this Agreement and may enforce it against you
• You represent that you are not located in a country subject to U.S. Government embargo
